Well now.........there was 18 of us on the bridge tonight and about 6 pm
three of Michael Berry's thugs showed up to find out that we were not
intimidated.......the point of recognition came when shelby (8yo) asked one
of them if he want to pet Mona her puppy. All three of them concluded it
might look bad if they were to come down hard on this group of middle aged
professional types with a four foot child carrying puppy. So......they said
their pleasant goodbyes and left.......without even asking "who is in charge
here? Or "What does your sign say? Or can I get your name and license
number?

They will be back........and what are we going to do if I can't bring shelby
and Mona next time?

Right on! We don't loose unless and until they drive us off the bridges.

I believe we have now gotten a dramatic confirmation of our success in
communicating our peace/justice messages to the community. The reason is
that we are now seen as a force to be reckoned with. Michael Beery has now
evoked the following process issues:
     1) What motives drive him and his camp to seek to use their positions
to shut down Free Speech/Protest?
   2) What further actions might we take now to bring Michael berry's stance

to advance our message to the larger general public?
   3) How might we use the public comment time at City Council on Tuesday,
when we have a right to use 2 minutes each to communicate that we want City
Council to affirm our right to free speech, and in particular to ask for the

City Council to consider a sanction on Michael Berry as abusing his
political position against us, Houston Citizens, as he has sworn to serve
faithfully and lawfully.
  4) How might we organize to picket his office or at tCity hall with signs
in response to his attack on the validity of our free speech rights, under
the cloak of "protecting traffic safety' when he can not provide any
evidence that there is a risre in traffice related accidents caused by our
free speech esercise ont he Bridges over Highway 59, as he so brazenly
asserts?
    5) Failing to provide reasonable evidence as a basis for his opposition,

we expect a public apology, as well as a declaration of his intention to
faithfully follow the U.S. Constitution in his position as an elected
official in the City of Houston. (Specifically in support of the 1st
Amendment).

Dr. Joseph Kaye
P.S. Thank you Michael Berry for showing us your true colors.

We could always respond 'sideways' by tallying the number of motorists on
cell phones during rush hour and pointing out that in many states the use of

cell phones by motorists in the driver's seat is illegal because it poses a
danger by distracting them. I'd guess about 80% of the people driving along

during rush hour are talking on the phone.

We could also, of course, charge the obvious, that this is a tactic to
prevent free speech and it is coming from people opposed to the message
we're sending.

City Council gives us a new venue for the blogging as well. We can
always blog there and get more news coverage....

Silencing protestors to keep traffic flowing 03:40 PM CDT on Tuesday,
April 3, 2007 By Doug Miller / 11 News
Protestors gather every week on bridges over the Southwest Freeway.
But now Houston Councilmember Michael Berry wants to shut the
demonstrations down. Well, you dont have a right to yell fire in a
crowded theater. And you dont have a right to stand on a freeway and create

gridlock. And when somebody gets killed on that freeway, thats going to be
well beyond their first amendment rights. We have a public safety right and
a responsibility and a duty to stop them from distracting traffic and
creating gridlock. And were not going to let them continue to do it.

   KHOU - TV
Demonstrators like Bob Carter believe theyre catching heat not because
of their medium, but their sometimes politically unpopular messages. He
thinks that we might be causing a traffic problem. That is simply not true,

because you can go out there any day of the week at 5:00 to about 6:30 and
sometimes later, even at 5:00, its like a parking lot out there. So we are

not causing a traffic problem.
Still, constitutional law experts like Gerald Treece say city governments

can and do declare some places off limits for exercises of free speech.
Heres the catch, though. Theyve got to be really serious about it. They

cant ban one type of speech and then permit signs saying, Go Texans or
Go Astros. They have to be totally viewpoint and content neutral.
Thats part of the reason our legal expert believes the city government
would have a tough time chasing the protesters away from the Southwest
Freeway.
